Gay man approaches Supreme Court for recourse

A gay man Eduardo Guillermo Delgado Castaneda has approached the Supreme Court challenging an earlier judgment he lost with costs in the High Court over his legality to stay in the country.

He argues that he is domiciled in Namibia.

His new challenge claims his rights in terms of Article 18 of the Namibian Constitution were violated by the government as ‘he is domiciled in Namibia’.

Castaneda, who is the appellant, listed the Ministry of Home Affairs and Immigration and Chief of Immigration as the respondents.
